Terms of Service

1. Agreement to terms

By creating an account or using LinksWatcher ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms constitute a legally binding agreement between you and LinksWatcher, operated by Amine LAL.

2. Description of the Service

LinksWatcher is an AI-powered affiliate link monitoring platform that:

• Monitors affiliate URLs you submit for stock availability, pricing changes, and link integrity.
• Uses AI Vision technology (screenshot analysis via GPT-4o) to detect product page status.
• Delivers alerts via email and Telegram when monitored links require attention.
• Provides revenue impact estimates, replacement product suggestions, and scan history dashboards.
• Offers API access for programmatic integration (Premium plan).

3. Account registration

To use LinksWatcher, you must create an account with a valid email address. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access to your account.

4. Acceptable use

You agree to use LinksWatcher only for lawful purposes. The following activities are prohibited:

• Submitting URLs for monitoring that violate third-party terms of service or applicable law.
• Attempting to reverse-engineer, decompile, or extract the AI Vision engine or scanning infrastructure.
• Using the API in ways that exceed rate limits or attempt to circumvent plan restrictions.
• Sharing your account credentials with third parties or creating multiple free accounts to circumvent plan limits.
• Using LinksWatcher to harass, stalk, or harm other individuals or businesses.
• Submitting malicious URLs designed to exploit our scanning infrastructure.

5. Plans, billing, and payments

LinksWatcher offers Free, Pro, and Premium plans with different feature sets and link limits:

• Free plan: Limited features and link quota. No credit card required.
• Paid plans (Pro, Premium): Billed monthly or annually via Stripe. Prices are displayed in your billing dashboard.
• You may upgrade, downgrade, or cancel your subscription at any time from your account settings.
• Downgrades take effect at the end of the current billing period. Excess links are not deleted but stop being scanned.
• Refund policy: We offer a 14-day money-back guarantee for first-time subscribers. After 14 days, payments are non-refundable.
• We reserve the right to modify pricing with 30 days' advance notice via email.

6. Service availability and SLA

We strive to maintain high availability but do not guarantee 100% uptime. LinksWatcher is provided "as is" and "as available." Scheduled maintenance windows will be communicated in advance when possible. We are not liable for damages resulting from service interruptions, whether planned or unexpected.

7. Data and intellectual property

Your data remains your property:

• You retain ownership of all URLs, notes, and content you submit to LinksWatcher.
• You grant LinksWatcher a license to process your submitted URLs for the purpose of providing the monitoring service.
• Scan results (screenshots, AI analysis, metadata) generated by LinksWatcher are part of the Service and are provided to you under your plan terms.
• LinksWatcher's AI Vision engine, scanning infrastructure, codebase, and brand assets are our intellectual property and are protected by applicable laws.
• You may export your data at any time via the CSV export feature or API (Premium).

8. Third-party platforms

LinksWatcher monitors publicly accessible web pages. We do not access password-protected content, private APIs, or restricted areas of third-party platforms. Our monitoring activities comply with standard web crawling practices. However, you are responsible for ensuring that the URLs you submit comply with the respective platform's terms of service (e.g., Amazon's Terms).

9. Limitations of liability

To the maximum extent permitted by law:

• LinksWatcher is not responsible for the accuracy of AI Vision verdicts. While our AI achieves high accuracy, it may occasionally produce incorrect results.
• We are not liable for revenue losses resulting from undetected Zombie Pages or delayed alerts.
• We are not liable for decisions you make based on LinksWatcher's data, reports, or recommendations.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if we determine that you have violated these Terms, with or without notice depending on the severity of the violation. Upon termination, your data will be deleted within 30 days, consistent with our Privacy Policy.

11. Modifications to these terms

We may update these Terms of Service from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
